New York Medical Malpractice Lawyers at Fitzgerald & Fitzgerald Settle Multi-Million-Dollar Lawsuit

The New York medical malpractice lawyers at the law firm of Fitzgerald & Fitzgerald have been handling New York medical malpractice claims on behalf of clients for more than 40 years. The firm handles several types of medical malpractice cases including those that deal with birth injuries. The firm has recently concluded another New York birth injury lawsuit by agreeing to a settlement with the defendant in the amount of $7,300,000.00. The case concerned an infant who was permanently injured as a result of the alleged negligence of the defendant.

Specifically, the lawsuit was filed against the defendant that was named as New York Methodist Hospital, and the case after being filed was assigned a number of 96181A. The lawsuit sought damages from the defendant based on allegations that the staff at the medical facility did not properly monitor the conditions of the infant and the mother prior to the birth of the plaintiff child. The court documents alleged that as a result of this negligence, the plaintiff child suffered several injuries and has been diagnosed with several permanent conditions.

The court documents describe the situation such that the mother reported to the hospital the day prior to the birth, complaining of severe abdominal cramps and bleeding. The mother was placed on magnesium sulfate but wound up giving birth to the child the next day at a gestation period of 29-30 weeks. The mother had diabetes and had previously given birth to a stillborn at 30 weeks of pregnancy.

The court documents state that the child was born with several conditions that included severe respiratory distress syndrome, sepsis, funisitis and acute chorioamnionitis, bronchopulmonary dysplasia, hyperbilirubinemia, and birth asphyxia. Fitzgerald & Fitzgerald successfully argued that New York Methodist Hospital, its agent and employees failed to properly monitor the fetal condition prior to delivery by means of electronic fetal heart monitor [EFHM] and deliver immediately by cesarean section given the first signs of fetal distress as evidenced by a non-reactive non-stress test [NST]. The defendant agreed to settle the case for $7.3 million.
